You are the User!
Qitio only provides products and services to users of the age 14 and older. By using Qitio services you confirm that you are 14 years of age or older. Users can be resident of any country unless that country is explicitly excluded from the Qitio service.
Qitio also provides services to legal entities. Purchasers of these identities must prove that they can act on the behalf of the respective entity.
Countries
The Qitio service is open to all users in all countries except of Bahrain, Bangladesh, Botswana, China, Egypt, Equatorial Guinea, Indonesia, Iran, Iraq, Japan, Jordan, North Korea, Kuwait, Malaysia, Mongolia, Pakistan, Saudi Arabia, Singapore, Somalia, Sudan, Syria, Uganda, the United States of America, Vietnam, Yemen. People wishing to use the Qitio Services in those countries please contact the Qitio Company in Poland directly to receive special terms for these countries.
The Qitio Homepage
The Qitio Homepage is defined as www.Qitio.com and its variations with other top level domains (e.g. www.Qitio.pl, www.Qitio.de ). The Qitio company does not own all URLs containing "Qitio" as part of the Domain name. These Terms only apply for Homepages which contain these Terms as part of their Homepage and which are official Homepages of Qitio Sp. z o.o. based in Warsaw, Poland.
Persons - Alarm Strategy
The Qitio System allows to inform one or several persons in case of an alarm. The User may only route Alarms or other notification to persons or entity of whom he has the approval to do so. The User will keep the Qitio Company clear of any claims from notified persons, especially when these persons or entities have been notified accidentally as a result of the User misspelling their name or communication address (Tel, Email).
Purpose
The Qitio System is designed to supervise areas and trigger alarms. The User may not use the Qitio system for any other purpose. Especially, he may not use the notification system / Alarm Strategy to distribute Advertising (or any other commercial content), Pornographic Content or any other illegal transactions.
Respecting the Law
The User will use the Qitio system only for action which are in line with the governing law of the country the Qitio Device is positioned by the User.
Loss of Data
The Qitio company stores data in the context of the services it supplies to the user. In the unlikely case of a total or partial loss of data the Qitio company does not pay any redemption to the user neither for the effort for restoring the data nor for any consequential losses.
Conflict with law
If any clause of these Terms conflict with Polish Law or the national law of the User's country (the county the goods have been shipped to) then the Terms still remain valid except of the clause being in conflict. Both parties agree that such a clause may be replaced by the Qitio company which reflects its spirit and then does not violate against the Polish Law nor the law of the User's country.
Court
In case of an irresolvable dispute the only responsible court is Warsaw, Poland.

Terms
These Terms apply for all visitors of the Qitio Homepage.
Registration
By registering with the Qitio Homepage, the User agrees that all information provided to the Qitio Homepage is true and accurate and you he update this information in order to keep it current, complete and accurate.
During the registration process, the User will be asked to select a password. The password and your account are for your individual use only, and are not to be shared with co-workers, friends or family. The User agrees to keep his password confidential at all times.
The User agrees to be fully responsible for activities or transactions that relate to his User Account and his password. He must notify the Qitio Company immediately if he learns of an unauthorized use of his account or password.
Linking
You may not link to the Qitio Homepage if you don't agree to the full terms. You may not link to the Qitio Homepage inside an User account.
Disruption
The User may not disrupt the Qitio Homepage by trying to achieve unauthorised access to functions which are not granted to Users, use functions with the intention to disturb the system, DOS Attacks, Robots or any other manipulative actions. The Qitio Company will use legal prosecution against anyone violating against this Disruption Clause.
Third Party Sites and Information
The Qitio Homepage may include links to other sites on the Internet that are owned and operated by Business Partners, online merchants and other third parties, and which may contain references to information, software, materials, products, and/or services provided by the third party. These third party sites may contain information which some people consider inappropriate or offensive. You acknowledge that these third party sites are beyond our control, and we are not responsible for the availability of, or the content located on or through, any third-party site. Please contact the Qitio Homepage Administrator for those third-party sites if you have any concerns regarding such links or the content located on such sites. Your use of those third-party sites is undertaken at your own risk, and is subject to the terms of use and privacy policies of each site. We include third party links or references merely as a convenience to our Users, and we do not endorse nor assume any liability for the third party websites, services, or products other than stated on the Qitio Packs.

These Terms apply for all Buyers of the Qitio Alarm Device
Intellectual Property
The Qitio Alarm Device and the Qitio Extension Pack is produced using the Intellectual Property of Qitio Sp. z. o.o., Warsaw, Poland. Both products may contain hardware components and firmware of other companies and entities. This hardware and firmware is part of the Intellectual Property of the respective companies or part of the Intellectual Property of entities they have taken a licence from. The user may not violate the Intellectual Property associated with the Qitio Alarm Device and the Qitio Extension Pack, especially he may not re-engineer the Software which is embedded in the Qitio Alarm Device.
Operation
The Qitio Alarm Device can only be operated in conjunction with the Qitio Service Pack or an Qitio xService Pack. Any other Usage is prohibited.
Guarantee
The Qitio Alarm Device and the Qitio Extension Pack have a 2 year Technical Guarantee.
The Qitio may only be used in dry areas with a temperature between -25 and +50 degree Celsius. It may not be exposed to water or strong electric or magnetic fields. It may not be exposed to any physical violence by human or natural sources (e.g. shock). It may not be used with any other SIM card as specified in the Qitio Service Pack or Qitio Service Pack.
The Qitio Alarm Device may only be charged with original power supply and only with currents as specified. It may not be altered in its specification (e.g. drilling holes in the case, attaching cables to the main board, exchanging parts). In case these conditions are breached the Technical Guarantee expires at the moment of the breach.
Additional Terms for the usage of the Qitio Service Pack
Terms
These Terms apply for all Users of a Qitio Service Pack.
Usage
The Qitio Service Pack contains a SIM Card. The SIM Card remains the property of the Qitio Company or the issuing Mobile Service Provider. The SIM Card is only be used with a Qitio Alarm Device. It is forbidden to insert it in any other device. Especially, it is forbidden to operate regular voice phone calls using the SIM Card or using it in any other context than the Qitio Alarm Device.
Roaming
The User may not use a Service Pack outside the country than marked on the Service Pack. There is no Roaming.
Guarantee of Service
There is no guarantee that the Service Pack will work in the intended location. The location may not be covered by the Mobile Service Provider or the location has an unfavourable position (blocked through walls, trees, mountains etc.) with the consequence that the Service Pack can not interact with the Mobile Network. In case you suspect that the location you want to operate my not be covered by a Service Pack it is recommended that the User - before purchasing a Service Pack or even before purchasing a Qitio Alarm Device - will test the location with a regular cellular phone using a SIM Card of the same Mobile Service Provider as the Service Pack does. Which Mobile Service Provider is used by the Service Pack can be obtained by request from the Qitio Company.
Interruption of Service
All Qitio products are designed to provide 24h / 7 days a week service. Knowing that 100% availability is technically not possible we are aiming at 99,9% availability of all Qitio Services.
Despite choosing all partners (Mobile Service Provider, Data Center host, Internet Service Provider, Hardware and Software Suppliers) with greatest care the Qitio Company can not reimburse the User of any consequential loss he may have suffered from a Qitio Product not functioning!
Especially, the Qitio company does not compensate for theft, loss or damage of goods and property caused by persons, fire, technical damage, natural catastrophe or any other reason where a Qitio Alarm device was used for alarm notification. We remind all Users that the Qitio Alarm Device does not prevent theft, vandalism or fire but is intended to reduce the damage by early notification of authorised persons. We strongly recommend to sign up for adequate insurances in order to protect your property!
We track down times of all Business Partners and the complete system. In order to use such a report as a purchasing decision for a prospectus User the Down Time Report is available from Qitio Company upon request.
In case in a given month the availability of any Qitio Service is below 98% all users who have registered their email address will be notified. In such a case the User has the option to terminate any Qitio Service Pack and any Qitio Security Pack in time period of weeks after notification. The User will be reimbursed in cash for the remainder of the Service (pro rata calculation).
Run time
Each Qitio Security Pak is specified for a certain total run time. This total run time is specified in months which is recalculated internally to days. It will start on the day the Qitio Security Pack has been activated by the User and expire automatically after the time period given.
The User can extend the Run Time by purchasing an Extension Period for his Qitio Security Pack. The purchase needs to be performed at least 7 days before the Qitio Security Pack expires. An expired Security Pack can not be extended.
After a Security Pack has expired the Qitio Company may request the User to send back the SIM-Card to the Qitio Company or any other destination specified by the Qitio Company. The cost of such a shipment will be reimbursed by the Qitio Company. If during 2 weeks after expiration the User has not received such a request he will destroy the SIM Card of the expired Qitio Security Pack.
In case of an expired Qitio Security Pack the Communication Account of that Security Pack will be set to Zero. There will be no refund for unused Data Volume. The User Account (expressed in money) of the User remains untouched.
Data Volume
Each Qitio Service Pack includes Data Volume for the communication between the Qitio Alarm Device and the Qitio Server as well as for the communication between the Qitio Server and the Device of the Users choice (SMS, Fax, Telephone (Voice),Email, Web). As these communication forms involve fees of Business Partners there is usually set a limit which has been included in the Qitio Service Pack.
The User can inform himself how much of the included Data volume he and his Qitio Alarm Device have consumed at a certain point. In case of a low Communication Account the User is expected to fill up his Communication Account with additional Data Volume via the Qitio Homepage. In case his Communication Account is "Zero" on one of the routes the respective route will be blocked until the Communication Account is filled up.
Free Data Volume maybe expressed in Sub-Periods - e.g. months - or over the full Run Time of the Qitio Service Pack. If it is expressed in a sub-period then Data Volume remaining on the Communication Account at the end of the sub-period will be set to Zero. This means that this Data Volume is not refunded nor can it be transferred to another Sub-Period nor can it be transferred to another Qitio Security Pack, even if that other Qitio Security Pack is in the possession of the same owner.
Additional Terms for the usage of the Qitio xService Pack
Usage
The Qitio xService Pack allows the User to operate the Qitio Alarm Device with a SIM Card of his choice. The Qitio xService Pack will cover the service delivered by the Qitio Server and the communication between the Qitio Server and the User.
Validity
These additional Terms for the Qitio xService Pack will be revised once the product is launched. For the time being the Qitio Alarm Device can only be operated with the SIM-Card provided by the Qitio Service Pack.
Additional Terms for the usage of the Qitio Security Pack
Terms
These Terms apply for all users of the Qitio Security Pack.
Qitio Company is Agent
For all Security Services the Qitio Company is not supplier of these services but only its agent. The selected Security Company is stated on the Packing of the respective Qitio Security Pack. All terms of the relevant Security Company apply.
Change of Security Company
In exceptional cases the Qitio Company may decide to discontinue the business relation with a specific Security Company and not allow it anymore to use the Qitio system to sell its service or route alarms through it. In this case the User will be notified by the Qitio Company and he will receive the choice of
a)transferring free of charge those parts of his Qitio Security Pack which are unused to an alternative Security Company or
b)receive a refund in cash for the unused parts of his Security Pack. Pro rata calculation applies or
c)- if applicable - transfer the unused part of his Security Pack to a system used by the incumbent Security Company.
Visit Records
Security Companies will visit a premise when they have been included in an Qitio Alarm Strategy by the User and the User has a valid not fully used Qitio Security Pack.
The Qitio Company will keep records of all visits of a Security Company entered to the Qitio system for 3 years.
Guarantee
The Qitio Company selects their Business Partners with great care. If local law mandates specific licences for Security Company it will only select Security Companies as Business Partners which can present such a licence. The Qitio company can not give any guarantees, especially not on the stated maximum response time of the Security Company. Hence, all claims concerning consequential losses will be directed by the User directly to the security company.
Additional Terms for the Qitio online Shop ("e-shop")
Terms
These Terms apply for all transactions performed via the Shop function on the Qitio Homepage by the buyer. In case these Terms change those Terms are applicable which have been valid on the day of purchase.
Description of Service
The user orders Qitio goods and services for himself or on behalf of an legal entity for which he is authorised to act upon. These products are delivered on a postal way to him if they are tangible (e.g. a Device or a Service Pack including a SIM card) or, in case of a service, are credited to his Service Account. In return the User pays the products or services via a means offered by the Qitio Homepage.
Prices
Prices in the e-shop may deviate from prices for identical Qitio products in retail outlets.
Order
An order to the e-shop is accepted when the e-shop confirms the order on the Qitio Homepage in the e-shop section or via email. An Order needs to be complete in order to be accepted. The Qitio Company can cancel an order after accepting it if the payment method chosen by the User for the Order does not succeed to deliver a complete payment within 5 days.
Cancellation of Order
Before the shipping of ordered goods the User can cancel the order up to 14 days after the ordering date. Already paid amounts will be fully refunded by the Qitio Company. If an Order has been shipped is notified under "Order Status" on the Qitio Homepage.
Services which lead directly to an increase of the Service Account (e.g. purchase of "Security Packs") can't be cancelled.
If the Qitio Company is not able to deliver the goods to the User because of Out-of-Stock situation, technical problems, specification changes it may cancel the order within reasonable time. In this case the Qitio Company will immediately contact the User, repay any funds already paid by the user for the Order and may suggest an alternative product representing the same or similar functionality as the original ordered product.
Return of Goods
The User can return the goods up to 3 weeks after reception and as long as he hasn't used them. Just opening the original packaging does not count as usage. The user may return the goods to the address stated below without providing any reason for him returning the goods. The Qitio company will return the paid price for the goods to the user but will not return the fees charged for packing and shipping paid by the User to the e-shop . If the User has a negative account balance with the Qitio company then the amount will be first used to balance the account.
Damaged Goods
The User will check when receiving the goods ordered from the e-shop if they are not damaged and shipment is complete. In case of damage or incompleteness he will inform the Qitio company via email, standard letter or phone and necessary steps will be taken with the Qitio company. Complaints will be only accepted 5 days after reception of goods.
No Delivery
The status of any purchase in the e-shop can be monitored by the user on the Qitio Homepage. After shipment, the goods are expected to reach the User within 3 weeks. The User will inform the Qitio company if a specific shipment has not reached him after 3 weeks in order to allow the Qitio Company to investigate the case.
Packing and Shipping
Goods offered in the e-shop have different weights, different sizes, different transport requirements and will be shipped to different destinations. When purchasing goods in the e-shop before committing the order the user will be informed about the charge for Packing and Shipping. This charge will not be refunded if the User returns the goods due to his own motivation.
In case an Order can only completed partially by the e-shop and a second or further deliveries are required to meet the full order then only Packing and Shipping of the original Order is charged by the e-shop, assuming the order had been delivered during one shipment.
Property
All goods purchased in the e-shop remain the property of the Qitio company until they are fully paid.
Guarantee
The Qitio company guarantees that all new goods delivered to the user are free of technical faults. All technical goods (e.g. the Qitio Alarm device, Extension Packs but not Security Packs and not Service Packs) are subject to national guarantee legislation of the country where the goods have been shipped to.
Resellers
A Reseller is a person or entity who purchases and sells more than 5 single items of the Qitio e-shop in the time period of 2 years. Reseller can not order from the Qitio e-shop. They need to contact the Qitio company directly. All Qitio products purchased through a Reseller will be blocked in their function by the Qitio company.
